Who we are and what these terms cover<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">DareToCloud (\u201cwe\u201d, \u201cus\u201d) is a web agency based at Tour &amp; Taxis, Brussels, Belgium, VAT BE 1014.970.386, contact@daretocloud.com.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These terms govern our subscriptions (website maintenance, hosting, SEO, GEO and WebOps), our one-off projects (website creation, redesigns and custom development), and the use of our website and client portal. They are intended for professional clients (\u201cyou\u201d, \u201cthe client\u201d).<\/p>\n\n\n\n<h2 id=\"h-2-the-agreement-and-order-of-precedence\" class=\"wp-block-heading\">2. The agreement and order of precedence<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Our agreement with you consists of the proposal, order form or invoice you accept, these terms, and our <a href=\"https:\/\/daretocloud.com\/privacy-cookie-policy\/\">privacy policy<\/a>. For a subscription, the invoice or proposal you accept serves as the contract between you and DareToCloud.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a proposal and these terms differ, the proposal prevails. Our <a href=\"https:\/\/daretocloud.com\/help\/\">documentation<\/a> explains how our services work. These terms govern.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may accept a proposal or invoice by starting work. Paying the first invoice, or approving a proposal in writing, means you accept the agreement.<\/p>\n\n\n\n<h2 id=\"h-3-your-registration-obligations\" class=\"wp-block-heading\">3. Your registration obligations<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To use our services and the client portal, you confirm that you act on behalf of a business or organisation and have the authority to bind it, that you are of legal age to enter into a binding contract, and that you are not barred from receiving services under the laws of Belgium or any other applicable jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You also agree to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>(a) provide true, accurate, current and complete information about yourself and your organisation when prompted by our registration and onboarding forms (the \u201cRegistration Data\u201d), and<\/li>\n\n\n\n<li>(b) keep the Registration Data true, accurate, current and complete.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If you provide information that is untrue, inaccurate, not current or incomplete, or if we have reasonable grounds to suspect that it is, we may suspend or terminate your account and refuse any current or future use of the services (or any part of them), after written notice where reasonably possible.<\/p>\n\n\n\n<h2 id=\"h-4-account-password-and-security\" class=\"wp-block-heading\">4. Account, password and security<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You create a password and account designation when you complete registration. Each client gets access to the DareToCloud client portal, where requests, estimates, approvals and reports are exchanged. The ticket history is the record of what was asked and done.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You are responsible for keeping your password and account confidential, and for all activity that occurs under them. You agree to (a) notify us immediately of any unauthorised use of your password or account or any other breach of security, and (b) log out of your account at the end of each session. We are not liable for any loss or damage arising from your failure to comply with this section.<\/p>\n\n\n\n<h2 id=\"h-5-your-responsibilities\" class=\"wp-block-heading\">5. Your responsibilities<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You agree to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>give us the access we need to do the work (WordPress, hosting where relevant, Google Search Console and Analytics, and other properties as agreed), and keep that access valid;<\/li>\n\n\n\n<li>provide content, images, translations and approvals on time. Where a delay is caused by you, our delivery times are suspended for the length of that delay;<\/li>\n\n\n\n<li>make sure you own or are licensed to use everything you give us (text, images, logos, fonts, personal data);<\/li>\n\n\n\n<li>remain responsible for the accuracy and legal compliance of your content, including sector-specific legal and regulatory information, privacy and cookie notices, and any personal data of your team that appears on the site. We implement the content you supply and do not review it for regulatory compliance.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">We never change your branding or page copy without asking, and we never move or cancel anything (domains, hosting, accounts) without your written approval.<\/p>\n\n\n\n<h2 id=\"h-6-fees-billing-and-renewal\" class=\"wp-block-heading\">6. Fees, billing and renewal<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>All prices are in euros and exclude VAT unless stated otherwise.<\/li>\n\n\n\n<li>Subscriptions are billed monthly in advance from your signup date and renew automatically. Payment is due in advance, before work commences, unless the proposal sets a different schedule.<\/li>\n\n\n\n<li>We may change our fees with 30 days\u2019 written notice. You may cancel before the change takes effect.<\/li>\n\n\n\n<li>Late payment: unpaid invoices bear late-payment interest and fixed compensation as allowed under Belgian law governing late payment in commercial transactions. We may suspend services after written notice if an invoice stays unpaid.<\/li>\n\n\n\n<li>Payments already made are not refunded. If you cancel after a renewal has processed, that month runs to the end of its term.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-7-maintenance\" class=\"wp-block-heading\">7. Maintenance<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on your plan, we handle every month:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>WordPress core, plugin and theme updates, applied after compatibility checks and tested before going live. If an update breaks your site, we roll it back and fix it at our cost;<\/li>\n\n\n\n<li>daily backups, kept for 90 days, and daily malware scans and security monitoring;<\/li>\n\n\n\n<li>uptime monitoring with a 99.9% target;<\/li>\n\n\n\n<li>speed and Core Web Vitals work;<\/li>\n\n\n\n<li>the professional plugin licences we include in our plans. These licences belong to us, are not transferable, and end when your subscription ends.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Cleaning up a site that was already compromised before we took it over, or that was compromised through your credentials or through changes made by others, is quoted separately.<\/p>\n\n\n\n<h2 id=\"h-8-edits-and-what-counts-as-a-project\" class=\"wp-block-heading\">8. Edits and what counts as a project<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Your plan includes unlimited edits, done for you. \u201cUnlimited\u201d means we do not count your requests or bill per change. It does not mean unlimited development, and we do not judge requests by how long they take. The nature of the work is the test.<\/p>\n\n\n\n<h3 id=\"h-an-edit\" class=\"wp-block-heading\">An edit<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An edit is a change to what is on an existing page or to existing settings. Examples:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>text and copy changes anywhere on the site;<\/li>\n\n\n\n<li>swapping images, adding media (videos, photos, banners), replacing PDFs;<\/li>\n\n\n\n<li>adding a section to an existing page using existing design blocks;<\/li>\n\n\n\n<li>adding a page using an existing template or your existing theme layout;<\/li>\n\n\n\n<li>menu, navigation and footer changes, sidebar widgets, social media links and sharing buttons;<\/li>\n\n\n\n<li>form field changes, updated recipients, and setting up contact, newsletter or quote request forms (as long as a form does not exceed 5 pages or 50 fields);<\/li>\n\n\n\n<li>CSS adjustments within your existing design;<\/li>\n\n\n\n<li>publishing content you send us;<\/li>\n\n\n\n<li>plugin configuration and settings adjustments;<\/li>\n\n\n\n<li>fixing display or layout problems;<\/li>\n\n\n\n<li>updating prices, opening hours, team members, offices, business details and legal pages.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-a-project\" class=\"wp-block-heading\">A project<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A project changes how the site is built. Examples:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>new page templates, graphic or web design work, PSD to WordPress conversions;<\/li>\n\n\n\n<li>custom development, new functionality, custom post types, custom plugins, editing or debugging custom code;<\/li>\n\n\n\n<li>third-party integrations (CRM, ERP, booking, payment providers);<\/li>\n\n\n\n<li>full redesigns, rebrands, restructures;<\/li>\n\n\n\n<li>building a brand-new website or subdomain;<\/li>\n\n\n\n<li>migrations to or from another host, and domain changes;<\/li>\n\n\n\n<li>e-commerce build-out or catalogue imports;<\/li>\n\n\n\n<li>recovery of a compromised site (see section 7).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Projects are always quoted before work starts.<\/p>\n\n\n\n<h3 id=\"h-how-edits-are-handled\" class=\"wp-block-heading\">How edits are handled<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Requests are handled one at a time, in order of arrival, on a best-effort basis. Each edit is delivered within a maximum of 5 business days from receipt of a complete request, unless we agree a different period in writing. The period is suspended while we wait for content, information or approval from you.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We recommend grouping related changes into one ticket. A change that you provide in several languages counts as one request. Translation is not included unless your plan states it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Use of unlimited edits must remain reasonable and in line with normal maintenance of a site.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a request turns out to be a project, we tell you before doing anything and give you an estimate. We never start billable work without your approval.<\/p>\n\n\n\n<h2 id=\"h-9-support-and-service-levels\" class=\"wp-block-heading\">9. Support and service levels<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Support is provided through the ticketing system in the client portal, on Belgian working days (Monday to Friday, [9:00 to 17:00], excluding Belgian public holidays).<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Response time:<\/strong> we respond within 5 working days on Maintenance &amp; SEO plans, and within 24 hours on Maintenance, SEO &amp; GEO and Full WebOps plans. \u201cResponse\u201d means a person has read your request and told you what happens next and when. It does not mean the request is completed within that time.<\/li>\n\n\n\n<li><strong>Urgent issues<\/strong> (site down, security incident, broken forms or checkout): mark the ticket urgent or contact us on WhatsApp at +32 456 64 89 47. We handle these immediately, on every plan.<\/li>\n\n\n\n<li><strong>Uptime:<\/strong> the 99.9% figure is a target, not a guarantee, and does not give rise to service credits. It excludes planned maintenance, outages at third parties (hosting infrastructure, DNS, search engines and other providers), force majeure, and problems caused by you or by others working on your site.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-10-hosting\" class=\"wp-block-heading\">10. Hosting<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Hosting is included in our maintenance subscriptions. It covers one domain name with renewals and DNS managed by us, hosting for one website, daily backups, SSL, DDoS protection, antivirus and antispam, and ticket support through the portal. The hosting package included is the Small package unless your proposal says otherwise. If your site outgrows it, we tell you before it becomes a problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hosting is provided through Hostinger, on infrastructure located in the European Union and listed as green by the Green Web Foundation. We remain responsible to you for the hosting service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hosting ends when your subscription ends (see section 17). If you only need hosting without our other services, ask us for the applicable offer.<\/p>\n\n\n\n<h2 id=\"h-11-seo-geo-and-content\" class=\"wp-block-heading\">11. SEO, GEO and content<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We follow white-hat practice only: no bought links, no private blog networks, no keyword stuffing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We do not guarantee any ranking, traffic, number of leads, number of links, sales result, or citation by an AI system. Search engines and AI systems are complex, change constantly and are outside our control. Any improvement is a likely outcome of good work, not a promise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where your plan includes articles, copy or reports, they are produced with human editorial review, and we use AI as part of our production process. Nothing is published without your approval unless you enable auto-publish.<\/p>\n\n\n\n<h2 id=\"h-12-website-creation-and-other-projects\" class=\"wp-block-heading\">12. Website creation and other projects<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Projects start with a proposal or quote stating the scope, price, deliverables, timeline and number of feedback rounds. See also our <a href=\"https:\/\/daretocloud.com\/website-development\/\">website creation page<\/a>.<\/p>\n\n\n\n<h3 id=\"h-website-creation-process\" class=\"wp-block-heading\">Website creation process<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Unless your proposal says otherwise, a website creation project works as follows:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Step 1: Submit your information.<\/strong> Once you have filled in our form with your website content, brand elements and any specific requirements, we start on a first draft of your site.<\/li>\n\n\n\n<li><strong>Step 2: Receive your first draft (V1).<\/strong> Based on the information you provide, we create Version 1 (V1) of your website. This draft includes the initial structure, text and images, giving you a clear view of the design and content layout.<\/li>\n\n\n\n<li><strong>Step 3: Single iteration round.<\/strong> After receiving V1, you have one opportunity to request changes, in a single grouped email. Please review the draft thoroughly and list all revisions in one document or email, so that we address everything at once.<\/li>\n\n\n\n<li><strong>Step 4: Final delivery (V2).<\/strong> We implement the requested changes and deliver Version 2 (V2), which is the final version of the website. At this stage, the website is ready for launch.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Additional revisions beyond the V2 final delivery are not included in this package. Any further changes are considered a new project or service request.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If your proposal states a different number of feedback rounds, the proposal prevails.<\/p>\n\n\n\n<h3 id=\"h-changes-estimates-and-acceptance\" class=\"wp-block-heading\">Changes, estimates and acceptance<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Changes beyond the agreed scope or rounds are new requests, for which we give an estimate first.<\/li>\n\n\n\n<li>Estimates are estimates, not fixed prices, unless the proposal says so. Where work is billed on time and materials, the rate is the one stated in the proposal.<\/li>\n\n\n\n<li>You accept a deliverable by approving it in writing, by using it live, or by not sending feedback within 10 working days after we ask for it.<\/li>\n\n\n\n<li>If you stop a project midway, you pay for the work done up to that point.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-13-intellectual-property\" class=\"wp-block-heading\">13. Intellectual property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">On full payment, you own the deliverables we created specifically for you (your site content, design files created for you and the copy we wrote). We keep ownership of our tools, templates, methods and know-how. Third-party software, themes and plugins remain subject to their own licences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You grant us the right to use your content and materials for the purpose of delivering the services. We may mention you as a client and show the work in our portfolio, unless you ask us in writing not to.<\/p>\n\n\n\n<h2 id=\"h-14-data-protection-and-confidentiality\" class=\"wp-block-heading\">14. Data protection and confidentiality<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We handle personal data in accordance with the GDPR and our <a href=\"https:\/\/daretocloud.com\/privacy-cookie-policy\/\">privacy policy<\/a>. For personal data processed through your site (for example, contact form submissions), you are the controller and we act as your processor. A data processing agreement, including the list of sub-processors, is available on request and forms part of the agreement as soon as you accept it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each party keeps the other\u2019s confidential information confidential and uses it only to perform the agreement.<\/p>\n\n\n\n<h2 id=\"h-15-subcontractors\" class=\"wp-block-heading\">15. Subcontractors<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We may use subcontractors and service providers to deliver the services. We remain responsible for their work towards you.<\/p>\n\n\n\n<h2 id=\"h-16-warranty-and-liability\" class=\"wp-block-heading\">16. Warranty and liability<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We perform the services with reasonable care and skill. Our obligations are obligations of means, not of result.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To the extent permitted by Belgian law:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>our total liability under the agreement is limited to two months of the subscription fees you pay, calculated on the monthly fee in force when the event occurred. For a project, it is limited to the fee of that project;<\/li>\n\n\n\n<li>we are not liable for indirect damage, loss of profit, loss of business, loss of data (beyond restoring your site from the latest backup), or business interruption;<\/li>\n\n\n\n<li>we are not liable for the work of third parties, outages at third parties, or for the content you supply.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Nothing in these terms limits liability that cannot be limited under Belgian law.<\/p>\n\n\n\n<h2 id=\"h-17-term-cancellation-and-exit\" class=\"wp-block-heading\">17. Term, cancellation and exit<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is no long-term contract. Subscriptions run month by month. To cancel, tell us at least 3 working days before your renewal date, through the portal or at contact@daretocloud.com. There is no exit fee and you do not need to explain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Either party may end the agreement immediately by written notice if the other commits a material breach and does not fix it within 14 days of written notice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the agreement ends:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>your site and everything we made for you remain yours, and content we produced and published stays with you;<\/li>\n\n\n\n<li>we hand over all credentials, and provide a final backup export on request;<\/li>\n\n\n\n<li>migration to a new host is not included. We give your new provider what it needs and quote any migration work separately;<\/li>\n\n\n\n<li>professional plugin licences and tools that we include remain ours and stop with the subscription. You need your own licences to keep using them;<\/li>\n\n\n\n<li>hosting and portal access end at the end of the paid period. Backups are deleted after the retention period.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-18-force-majeure\" class=\"wp-block-heading\">18. Force majeure<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Neither party is liable for a failure caused by events beyond its reasonable control, including outages of the internet, power or third-party platforms, cyber attacks, strikes and government measures.<\/p>\n\n\n\n<h2 id=\"h-19-our-website-links-and-trademarks\" class=\"wp-block-heading\">19. Our website, links and trademarks<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The materials on our website are provided for information and may contain technical, typographical or photographic errors. We may update them at any time. We are not responsible for the content of the websites we link to, and a link does not imply endorsement. Use of any linked website is at your own risk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The DareToCloud name, logos and service names are our trademarks. You may not use them without our prior written permission.<\/p>\n\n\n\n<h2 id=\"h-20-changes-to-these-terms\" class=\"wp-block-heading\">20. Changes to these terms<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We may update these terms. For existing clients, we notify changes by email or in the portal at least 30 days before they apply. If you do not accept the change, you can cancel before it takes effect. Without a notice, the version that applied at signup remains in force.<\/p>\n\n\n\n<h2 id=\"h-21-governing-law-and-jurisdiction\" class=\"wp-block-heading\">21. Governing law and jurisdiction<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These terms and the agreement are governed by Belgian law. The courts of Brussels have exclusive jurisdiction.<\/p>\n\n\n\n<h2 id=\"h-22-contact\" class=\"wp-block-heading\">22.
